ASC – COPYRIGHTS

Preamble

The Central Salesian Archive (ASC) is reachable via archiviosalesiano.net.

It gives access to a selection of archival content, to copies of digital documents (through the collection of “digital items”), and to further content (thematic pathways…). The site also gives access to other sites. The site’s content is protected by copyright and/or by related Creative Commons licences, available at https://creativecommons.org/licenses.

These terms of use describe the main elements the user is invited to be aware of:

  • For any editorial information and/or content and the archival descriptions, a Creative Commons Attribution–ShareAlike 4.0 International licence applies (full text), including to any derivative works. For commercial products (books, articles, exhibitions… etc.) it is advisable to enquire (cf. Info).
  • In keeping with Europeana’s Public Domain Statement and the related international principles, guidelines and recommendations, when the ASC site makes available works whose copyright has expired, it acknowledges that the respective digital copies are in part in the public domain (it is nonetheless advisable to enquire on a case-by-case basis).
  • For the metadata relating to digital content, the Italian Open Data License V2.0 (IODL 2.0) applies.
  • For ontology and thesaurus elements, a Creative Commons 2.5 BY Attribution licence applies.
  • For digital objects subject to copyright, the XML structure of each digital object’s metadata specifies both the name of the holder of the analogue object and the name of the holder of the digital object. Both must be contacted to request the release for the use of the digital copy (in case of doubt, refer to Info).
  • The domain, logo, graphics and icons belong to the ASC, except for those of the Omeka templates.
  • The images on this website and in the database are copies of originals and may be reproduced or transmitted and used free of charge for personal use or in any publication, whether paper or digital, by any publisher, citing the source, preferably not for profit. Otherwise, please contact archivio@sdb.org to establish the appropriate agreements and/or authorisations, also if you intend to reproduce images, drawings, maps or photographs as independent facsimiles for sale or for exhibitions, etc.
  • Those interested in the documentation must be aware that images originally published after 1936 (the year of Don Bosco’s canonisation) may still be protected by copyright, and it is their responsibility to verify the copyright status of such images before using them. We therefore ask that a good-faith effort be made to contact the original publisher of such images or otherwise determine their copyright status before using them, even after the appropriate use authorisation has been granted. Images without a download button are not available for use other than that of the website. Original publishers and information can usually be found on archiviosalesiano.net. However, there may have been shortcomings for various reasons.
  • This work – as indicated in point 1 – is licensed under a Creative Commons licence. By downloading any image from this site, those interested accept the terms of that licence. Users are required to comply with all copyright laws. Distribution, reproduction or other use require the written authorisation of any copyright holder and other rights holders, unless the materials are in the public domain or permitted by fair use or another statutory exemption. It is the user’s obligation to determine and satisfy the copyright or other-use restrictions when publishing or otherwise distributing the materials in the collections of this site. For images, maps and documents not in the public domain that we know to be sold by their creators, we do not allow their download or printing, and we try to provide a link to the creator’s site in our metadata.

CONDITIONS AND TERMS OF USE

Limitation of liability

Under no circumstances can the ASC be held responsible for damages of any kind, caused directly or indirectly by access to the site, by the use of the interactive tools, by the inability or impossibility to access it, or by the use of the information it contains. Quotations for news or review purposes are permitted if accompanied by the indication of the source “ASC” and the uniform resource locator (URL). The ASC reserves the right to reproduce the texts in other publications, citing the sources.

Changes to the terms of use

The ASC reserves the right to modify the site and these terms of use at any time. Any changes will be communicated on the site.

Usage limits

The ASC reserves the right to deny access to online services deemed reserved or confidential to particular users or groups of users at any time, without obligation of notice and without any liability towards users or third parties.

Error reporting

The ASC welcomes reports of malfunctions; indeed, users are invited to report any errors by sending a message to: archivio@sdb.org.

Access to linked external sites

The ASC indicates external sites or uses its own online services to facilitate access to them. Sites indicated in any way by the ASC, developed by parties over which the ASC has no control, may not work. Therefore the ASC has no responsibility for these sites, which can be reached via the links placed within the ASC site. The ASC is not responsible for the information obtained by the user or visitor of the site through the hypertext links reached. The completeness and accuracy of the information are the responsibility of those in charge of the sites accessed, under the conditions they establish.

PRIVACY

This page describes how the site is managed with regard to the processing of the personal data of the users who consult it. It is a notice provided pursuant to art. 13 of Legislative Decree no. 196/2003 (“Code on the protection of personal data”).

Cookies

The ASC does not use “cookies” and does not acquire information that would allow the user to be identified.

User responsibility

The user must be aware of these terms of use and assume any liability arising from the use of the site. The user acknowledges being responsible for any use of the site by themselves or by anyone using their personal data.

Browsing data

The computer systems and software procedures used to operate this website acquire, in the course of their normal operation, some personal data whose transmission is implicit in the use of the Internet communication protocols. This is information that is not collected in order to be associated with identified data subjects, but which, by its very nature, could — through processing and association with data held by third parties — allow users to be identified. This category of data includes the IP addresses or domain names of the computers used by users connecting to the site, the URI (Uniform Resource Identifier) addresses of the requested resources, the time of the request, the method used to submit the request to the server, and other parameters relating to the operating system and the user’s computing environment. This data is used solely to obtain anonymous statistical information on the use of the site and to check its correct functioning, and is deleted immediately after processing. The data could be used to establish liability in the event of hypothetical computer crimes against the site.

Data provided voluntarily by the user

The optional, explicit and voluntary sending of email to the addresses indicated on this site entails the subsequent acquisition of the sender’s address, necessary to respond to the requests, as well as of any other personal data included in the message. The processing of sensitive or judicial data is excluded; if provided by the user, it will be deleted.

Place of data processing

The processing connected with the web services of this site takes place at the ASC’s premises.

Method of processing

Personal data is processed with automated tools for the time strictly necessary to achieve the purposes for which it was collected. Specific security measures are observed to prevent data loss, illegal or incorrect use and unauthorised access.

Rights of the data subjects

The subjects to whom the personal data refers have the right at any time to obtain confirmation of the existence or otherwise of the data, to know its content and origin, to verify its accuracy or request its integration or updating, or its rectification (art. 7 of Legislative Decree no. 196/2003).

Data controller

Following the consultation of this site, data relating to identified or identifiable persons may be processed. The controller of their processing is the ASC.
